As ongoing investigations continue for the fatal truck accident involving well-known comedian and actor Tracy Morgan, Walmart has issued a response suggesting the plaintiffs may be at fault for their truck accident injuries.
The deadly New Jersey Turnpike crash occurred in June when a semi truck driven by a Walmart employee rear-ended Morgan's limo bus, leaving one dead and several others injured.
Evidence revealed that the driver of the truck, Kevin Roper, was speeding 20 mph over the limit and had been awake for more than 24 consecutive hours, a direct violation of safety mandates for the operation of commercial trucks.
Morgan's lawsuit against Walmart cited carelessness on behalf of the company for not ensuring employee compliance with federal regulations that protect employees and other motorists from the dangers of truck driver fatigue.
Due to ongoing investigations, Walmart refrained from directly addressing claims regarding Roper, but the company has since responded to Morgan's lawsuit, suggesting that the plaintiff injuries were actually a result of their failure to wear a seatbelt. The big box store is requesting a trial by jury, noting that neither the company nor its employees should be held responsible for truck accident damages which may have been caused by third parties.
